Terms of Service

1. Acceptance of Terms

By accessing or using the PassFast platform, APIs, SDKs, dashboard, or any related services (collectively, the “Service”) provided by Aberkane Software House FZ-LLC (“Company”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Description of Service

PassFast is a software-as-a-service platform that enables businesses to create, manage, and distribute Apple Wallet passes through APIs and a web dashboard. The Service includes pass generation, template management, certificate storage, push notification delivery, webhook integrations, and related tools.

3. Account Registration

You must create an account to use the Service. You agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain and promptly update your account information.
  • Keep your password and API keys confidential and secure.
  • Accept responsibility for all activity under your account.
  • Notify us immediately of any unauthorized use of your account.

4. Organizations and Access

The Service supports multi-user organizations with role-based access control. The account owner is responsible for managing member access and permissions. You are responsible for all actions taken by members you invite to your organization.

5. API Keys and Security

The Service provides secret keys (sk_live_) and publishable keys (pk_live_). You agree to:

  • Keep secret API keys confidential and never expose them in client-side code.
  • Rotate keys immediately if you suspect they have been compromised.
  • Use publishable keys only in contexts appropriate for public exposure.

We are not responsible for unauthorized access resulting from your failure to protect your credentials.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Infringe upon the intellectual property rights of any third party.
  • Distribute malware, spam, or deceptive content through wallet passes.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Attempt to gain unauthorized access to the Service or its infrastructure.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Circumvent any usage limits, rate limits, or access controls.
  • Use the Service to create passes that violate Apple’s Wallet guidelines.

7. Intellectual Property

The Service, including its software, APIs, documentation, and branding, is owned by the Company and protected by intellectual property laws. You retain ownership of all content and data you submit through the Service. By using the Service, you grant us a limited license to process your content solely to provide the Service.

8. Fees and Payment

Certain features of the Service may require payment. Fees are described on our pricing page and may change with 30 days’ notice. All fees are non-refundable unless otherwise stated. Failure to pay may result in suspension or termination of your account.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from Service downtime.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

11. Third-Party Services

The Service integrates with third-party services, including Apple Wallet and push notification services. We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party services is subject to their respective terms.

12. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your account if you violate these Terms. Upon termination:

  • Your access to the Service will cease immediately.
  • We may delete your data after a reasonable retention period.
  • Provisions that by their nature should survive termination will survive.

13. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Indemnification

You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, losses, or damages (including reasonable attorney’s fees) arising from your use of the Service or violation of these Terms.

16. Modifications

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised “Last updated” date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

17. Governing Law

These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai. Any disputes shall be resolved in the courts of Dubai, UAE.
